These Terms of Service ("Terms") govern your use of the Exhaling Research application ("Service") operated by Exhaling Research ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

You must be at least 13 years of age to use the Service. By using the Service, you represent that you meet this requirement. The Service is not directed to children under 13, consistent with our Privacy Policy.

Exhaling Research is a wellness application that provides breathing techniques and related wellness content. The Service includes:

• Access to breathing exercises and techniques
• Progress tracking and personal insights
• Community features and discussions
• Premium content and features (where applicable)
• E-commerce functionality for wellness products

When you create an account with us, you must provide information that is accurate, complete, and current at all times. You are responsible for safeguarding the password and for all activities that occur under your account.

You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

Some content in the Service (such as guided programs and digital guides) is offered as a one-time purchase ("Premium Services"). Prices are shown at checkout before you pay, and digital purchases unlock in your account after payment.

All fees are non-refundable except as required by law. Digital purchases remain available in your account for as long as your account exists.

Our Service includes an e-commerce platform where you can purchase wellness products. All purchases are subject to product availability and our acceptance of your order.

Prices are subject to change without notice. We reserve the right to refuse or cancel any order at any time. Shipping and return policies below form part of your purchase agreement.

Purchases are non-refundable except as required by law. For digital goods, once access or a download is delivered, refunds are not available except where mandatory consumer protections apply.

Damaged or defective physical items are handled case-by-case. Contact us promptly with photos and your order number so we can arrange a replacement or other remedy when appropriate.

For international shipments, you are responsible for any customs duties, taxes, brokerage fees, and import restrictions imposed by the destination country.

The Service and its original content, features and functionality are and will remain the exclusive property of Exhaling Research and its licensors. The Service is protected by copyright, trademark, and other laws.

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever including but not limited to a breach of the Terms.

Upon termination, your right to use the Service will cease immediately. Provisions that by their nature should survive termination (including ownership, warranty disclaimers, indemnity, and limitations of liability) will survive.

If you wish to terminate your account, you may do so from your profile settings or by contacting support. Discontinuing use alone does not delete your account data.

In no event shall Exhaling Research, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service.

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law provisions. You agree that any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Florida, and you consent to personal jurisdiction and venue there.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect.

What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
